Property auctions can provide landlords and property investors with opportunities to purchase residential, commercial and development property. However, buying at auction differs significantly from buying property through a conventional estate-agent sale.
Before bidding, prospective buyers should carefully read the auction's conditions of sale and investigate the property's title, occupation, municipal accounts, zoning, condition, reserve price and any costs or liabilities that may become the purchaser's responsibility.
Buyers should also establish whether VAT or transfer duty applies, whether an auctioneer's or Sheriff's commission is payable and what deposit must be paid immediately after a successful bid.
What is a Sheriff Property Auction?
A Sheriff property auction, sometimes referred to as a sale in execution, normally takes place after a court has authorised the attachment and sale of a property to satisfy a judgment debt.
These sales should not automatically be confused with ordinary bank repossessed properties. A property may first be offered at a sale in execution and, in some circumstances, subsequently become a bank-owned property.
Buyers considering Sheriff auctions should obtain and carefully review the conditions of sale and make appropriate legal, financial and property enquiries before bidding.
