A residential lease is one of the most important documents in the landlord and tenant relationship.
Many landlords continue using lease agreements that were downloaded from the internet, supplied by an estate agent years ago, copied from another landlord, or repeatedly amended without considering whether the clauses remain suitable.

Residential Lease Compliance in South Africa
Residential landlords in South Africa must ensure that their lease agreements operate within the applicable legal framework.

What Does the Free Lease Review Include?

Why Review Your Lease Before Signing?
Once a lease has been signed, changing its terms may become considerably more difficult.
Landlords should therefore consider reviewing their documentation before giving it to a prospective tenant for signature.
A well-drafted lease should clearly explain:
what the tenant must pay, what each party is responsible for, how the property may be used, what happens if the agreement is breached, and how the tenancy may lawfully come to an end.
Clear documentation can reduce uncertainty and help prevent avoidable disputes.

Is the lease review free?
Yes. The initial Residential Lease Review and Compliance Check is provided as a member benefit, subject to the terms of the service.
I am not a member. Can I still submit a lease?
The free review is a membership service. If you are not currently a member, you can join the Landlord Association South Africa and then use the service.
Can you review an estate agent’s lease?
Yes. Even where a lease has been supplied by an estate or letting agent, an independent review from the landlord’s perspective may identify issues worth considering.
Can you review a lease downloaded from the internet?
Yes. Generic templates may contain provisions that are inappropriate, outdated, or incomplete for a particular South African residential tenancy.
Can you review an existing signed lease?
Yes. An existing lease can be reviewed to identify potential issues. However, identifying an issue does not necessarily mean that a signed agreement can simply be changed without the tenant’s agreement or another lawful basis.
Does the review guarantee that my lease is legally compliant?
No. The review is intended to identify potential compliance issues, missing provisions, and areas of risk. It is not a guarantee that a lease will be suitable for every situation or that a dispute will not arise.
Does a good lease prevent tenant disputes?
No lease can prevent every dispute. However, clear and appropriately drafted terms can significantly reduce uncertainty and provide better evidence of the parties’ respective rights and obligations.
